These Terms and Conditions (the “Terms”), together with the documents referred to within them, set forth the legal terms and conditions governing your use of the website operated by KATA Jewellery Ltd, katajewellery.com, its contents and products.

We reserve the right to change these Terms & Conditions of use from time to time. If this happens, we will notify you by posting the new Terms & Conditions of use on the website. If you do not wish to be governed by the revised Terms & Conditions of use, please refrain from using the website.

These Terms & Conditions of use are governed by the law of England and you and we agree to use the English courts if there is any dispute between us.

If any part of these Terms & Conditions of use is found to be invalid by law, the rest of them remain valid and enforceable.

The use of this website means that you are agreeing to accept the terms and conditions of use. These terms and conditions can be printed out by selecting print from the file menu of your browser.

General

The terms “We”, “Us”, “KATA” and “KATA Jewellery” means KATA Jewellery Ltd

The term “You”, “Client” or “Customer” means the person using the website

By using the website you confirm that you are at least 18 years old, or, if you are under 18, that you are accessing the website with the consent of your parent of guardian.

You may not copy, reproduce, distribute, republish, download, display, post or transmit any part of the website without written consent from us. Images or content from this website are property of KATA Jewellery Ltd and must not be used for commercial purposes.

The images on the site are for informational purposes only and are automatically protected under UK copyright law.

You shall not use the website in any way that will damage it or interrupt its provision. You shall not use the website to transmit or post any computer viruses. Although all necessary provisions have been put in place, we cannot guarantee that the website is free from computer viruses, and you should take your own precautions in this respect.

We will try to make sure that the website is always available. However, this is not always possible, and we are not liable if the website is unavailable.

The website may contain links to third-party websites; these external websites are not under our control. We cannot be held responsible for such websites and cannot make any guarantees about them. We provide these links because we think they might interest you, but we do not accept responsibility for them.

We do not guarantee that the Site or any content on it will be free from errors or omissions. While we will always make every effort to avoid errors but if they do occur we will not honour inaccurate or incorrect prices.

We reserve the right to terminate the website or remove any of the services on it with immediate effect at any time.

Placing an Order

During the checkout process you will be prompted to create an account. This allows us to communicate with you regarding your order.

Once we have received your order, you will receive an email acknowledging the details of your order. This email is not an order confirmation but rather recognition that we have received your requested order.

All KATA Jewellery pieces are handmade to order in our London studio. They are a luxury, handmade product that is not mass produced.

When your order is received it may take anywhere from a few days to a few weeks to produce. We aim to deliver your piece of KATA Jewellery within 4 weeks of order unless otherwise stated on the product page.

Please be aware that some pieces will be delivered sooner. The delivery date is changeable depending the nature of the piece but you will be given an estimated delivery date when your order is confirmed.

If we are unable to complete your order, you will be notified via email within 5 business days and will not be charged for orders that cannot be fulfilled.

Once an order has been placed it cannot be modified in any way. If you have any special requests please add these to your notes while placing the order and we will respond via email.

We reserve the right to decline your order in the event that we are unable to obtain authorization for payment, or there are shipping restrictions for a particular item, or we do not have the materials in stock.

Items in your shopping bag are not reserved and may be purchased by other clients.

Payment

Our prices may be subject to change without notice.

You may check out using the ‘Paypal’ or ‘WorldPay’ gateways. The ‘WorldPay’ gateway accepts Visa, Mastercard, Maestro & JCB.

When using these payment gateways none of your personal payment details are passed back to and / or stored by KATA Jewellery.

KATA Jewellery has been certified PCI DSS compliant by Worldpay UK.

Delivery

Shipments dispatched remain our responsibility until received by the recipient. KATA Jewellery is not responsible for jewellery where delivery has been attempted but no signature was obtained by the delivery company.

Damaged or tampered shipments must have the word ‘DAMAGED’ written by the receiving person on the delivery agent’s paperwork. Failure to do this will result in the shipment becoming uninsured and KATA Jewellery will not accept responsibility for this.

Jewellery shipped to destinations outside mainland UK may be liable to tax or duty charges applied by the recipient’s country’s customs. This is out of the control of KATA Jewellery and is something we do not accept responsibility for. The payment of any customs duties or import tax levied is the responsibility of you, the recipient.

Jewellery returned remains the responsibility of the customer until received by KATA Jewellery together with the appropriate paperwork and packaging (see Refund & Exchanges Policy for more information).

Jewellery is not guaranteed for delivery on Saturday unless specially arranged and KATA Jewellery not responsible for any loss or claim resulting from this fact.

Refunds & Exchanges

We hope you are delighted with your piece of KATA Jewellery. If for any reason you decide not to keep your online purchase, We will accept products in its original condition and packaging when accompanied by the original sales invoice.

For a full refund items must be returned within 14 days from date of delivery.

For an exchange for an item of the same or higher value (with the difference in value to be invoiced to you) the original item must be returned within 30 days of delivery.

Bespoke items, including, but not limited to, one-off designs; special orders on stock items (i.e- rings ordered in a larger or smaller size than our standard stock) and engraved or personalised pieces, are non- returnable.

In the unlikely event that your piece of KATA Jewellery is received with a manufacturing fault then please contact us within 14 days of receiving the item. The item should then be returned to us before a replacement product or a product of the same or higher value is sent out (the difference in price being invoiced to you, the client) or a refund is issued. All pieces returned with a suspected manufacturing fault will be assessed by our team of professionals before any replacement or refund is issued. If the fault is suspected to not be due to manufacturing fault but due to client negligence or misuse of the product, then no replacement or refund will be issued. The client can elect to pay for repair / refurbishment charges. Any damage or fault with an item not reported during the 14 day time period will be deemed due to wear and tear by the client and a repair charge will apply.

Returns should be made with all original packaging and enclosures. Take care to return any certificates that accompanied the item.

We cannot accept returns that have been worn, used, altered or damaged. We reserve the right to refuse return of any merchandise that does not meet the above return requirements according to Our sole discretion.

Refunds may only be issued in the same form as was utilised for payment. However, We will not be liable for any fee charged by your bank or financial institution on this refund. Refunds will not include shipping costs incurred.

Before returning the item(s), you will need to contact our customer service team on studio@katajewellery.com or via our ‘Contact’ page, quoting your original order number.

 

For your protection, please insure the return package for the full purchase amount and use a trackable postage or courier service. KATA Jewellery will not assume responsibility for reimbursement or compensation in the event that return packages are lost, stolen, or mishandled.

All returns must be sent to the registered business address of KATA Jewellery.

Care For Your Jewellery

All KATA Jewellery must be looked after with care. Jewellery is a precious item and does not like to mistreated or mishandled.

Although silver, gold and platinum are metals, they will over time scratch and scuff with general wear. Coloured gemstones and diamonds are capable of being chipped, scuffed, worn and damaged with wear and tear over time

There are a few points we would ask you to be aware of to increase the longevity of your jewellery and make sure it looks beautiful for years to come.

  • When not wearing your jewellery it is best to store them in either a jewellery box, jewellery roll or jewellery pouch. We would recommend you do not let your jewellery pieces touch each other, to minimise undue wear and tear.
  • From time to time your jewellery, especially the pieces containing gemstones and diamond, will need cleaning. You may bring this to us to have professionally done, but at home, you may use a very soft brush (such as a children’s toothbrush) and some warm, slightly soapy, water. DO NOT use any chemical cleaners and this may damage the finish of your jewellery and damage the surface of gemstones, especially pearls, opals, emeralds and other soft or porous stones. Dry using a soft, lint free cloth
  • Be aware that if you wear two pieces of jewellery next to each other, for example either two rings together on the same finger, or two rings on adjacent fingers that they may wear upon each other, bump against each other and cause damage.
  • Please be careful not to wear your rings when lifting heavy loads, or doing strenuous activities such as gym or gardening.

Ring Sizes

All ring sizes shown on the website are UK ring sizes.

If you do not know your UK ring size but you know your European, American or Other ring size then you may use an online conversion to see your approximate UK size. Please note that this is at your own risk and KATA Jewellery cannot accept responsibility for any sizing error. Any resizing subsequently required would be at your own cost.

If you do not know your UK ring size you can purchase through our website an easy to use ring sizer. The product comes with full instructions and is easy to use.

We will offer any sizing advice in good faith however the final responsibility of finger size choice lies with the customer as it is always a matter of personal preference.

Once you have decided on and ordered a ring at this desired size the decision is binding and you will be charged for any subsequent changes of ring size.

Diamond & Gemstones

KATA Jewellery only purchases diamonds from respectable dealers that adhere strictly to the Kimberley Process and every attempt is always made to ensure that diamonds are not sourced from countries that use the money to fund conflicts.

Diamond carat weights stated are within 0.05 carats of the exact weight to comply with FTC regulations.

Our gemstones and pearls are only purchased from respectable dealers with strict ethics policies.

Diamonds, gemstones and pearls are natural and untreated unless specified in the product text.

Design & Copyright

All of the designs, products, photography & text displayed on katajewellery.com are the company’s intellectual property and are automatically protected under design right. This means that the use of this material for any purpose without our written permission would be an infringement of UK Patent Law.

Any infringement of design right or copyright (such as copying by other manufacturers or retailers) would entitle us to take civil action in court with a view to seeking damages.

The term ‘unique’ or ‘unique design’ when applied to a design or product on this website means that the design has at least one difference to any other design on this website. Although we would never copy other people’s work, we cannot be held responsible for copies of our unique designs by other people known or unknown to us.

Liability

Under no circumstances shall KATA Jewellery Ltd be liable for any indirect, special, incidental or consequential damages of any kind, regardless of the form of action, whether in contract, tort (including negligence), strict product liability or otherwise, even if we have been advised of the possibility of such damages.
